Food for thought

New sentencing guidelines have been brought in for prosecution under the new Corporate Manslaughter and Health & Safety Offences causing death on Tuesday 27th October 2009.

In short, where a serious form of harm or where a death at work occurs, which can be attributable to a failure of the organisations risk management protocols and procedures, a company is looking at a minimum fine of no less than £500,000.00, and possibly an even higher fine of 2.5 per cent to 10 per cent of its annual turnover over the previous three tear period.

The bottom line baseline fine, for a first time offender (an organisation not an individual) pleading not guilty, is very likely to be 5 per cent of the organisations average annual turnover during the three years prior to sentencing.

After taking into account any mitigating factors, the Court would then arrive at a fine that will fall within the range of 2.5 to 10 per cent of the companies average annual turnover over the previous three years.

In addition, a minimum level of fine has also been set which a fine would not fall below. It has been proposed that this minimum fine would be no less than £500,000.00.The Sentencing Council, who published these guidelines on Tuesday the 27th October, stated that: ‘whilst the effect on employment of the “innocent” may be a relevant factor, the effect on shareholders, directors and prices will NOT be considered relevant’.

This is in addition to any other proceeding that may be taken against individual directors or members of senior management who may be held responsible for the breach that caused the harm or death. Girl gun runners

Teenage girls wanting to join violent male gangs are being forced into having sex and ferrying guns, knives and drugs, police and charities have found.

The girls, some as young as 13, want to join gangs to raise their own profile or to seek protection. Often they are swayed by the status given to the senior members of the gang.

When they first join they are told they must have sex with one member of the gang — and then find several of the gang waiting for them.

What has shocked welfare workers is that the girls accept the situation as normal and do not appreciate that they are being violated.

Armed Police on Street

A brand of replica gun sold on the high street as a starting pistol is behind a surge in gangland shootings that have led Scotland Yard to deploy armed patrols on London estates.

Olympic BBM 9mm revolvers, converted by criminals to fire real bullets, make up 40 per cent of the live-firing guns seized by the Metropolitan Police in the past year.

Despite being relatively easy to convert, the Olympic pistols are legally on sale in hunting, sports and outdoor shops across Britain for £80-90.

Project Griffin opens in Oxfordshire

Project Griffin was introduced in London by the City of London Police in 2004. Its aim was to heighten awareness and counter the threat from Terrorism and major disasters.

It was aimed at security personnel, facilities management and post room staff. The project was an overnight success and has now been adopted not only in London but has moved Internationally, being opened up in the US, Canada, Australia and South Africa.

On the 05 Nov Project Griffin is being rolled out in Oxfordshire. The programme has been bespoked to the requirements and challenges faced in a County. The location of the first awareness day is Eynsham Hall, North Leigh.

Thames Valley Police are keen to express that Oxfordshire is under no more of a threat than any other County but the threat from both International and Domestic Terrorism remains a real possibility and will do for the foreseeable future.

Project Griffin will give staff knowledge of how to manage situations such as identifying a suspect package and suspect behaviour amongst other relevant techniques.

Big Brother State

An astonishing £380 a minute will be spent on surveillance in a massive expansion of the Big Brother state.

The £200million-a-year sum will give officials access to details of every internet click made by every citizen – on top of the email and telephone records already available. It is a 1,700 per cent increase on the cost of the current surveillance regime……’

This on on top of our recent reports that the UK has more CCTV cameras than China, a Communist state.
